Canada Introduces Citizenship Pathway for Undocumented Migrants

The federal government of Canada is set to introduce a pathway for undocumented migrants to gain citizenship while also expediting deportation procedures for those without official status. This initiative is part of Immigration Minister Marc Miller’s Citizenship Bill.

Prime Minister Justin Trudeau emphasized the need for support and regularization for undocumented individuals, stating that some may require an accelerated deportation process. 

Undocumented migrants in Canada include individuals who have overstayed their temporary status or remained in the country following rejected asylum claims. 

In October 2023, Immigration, Refugees, and Citizenship Canada (IRCC) reaffirmed its commitment to exploring regularization options for those contributing socially and economically to Canadian communities

IRCC values its ongoing dialogue with stakeholder organizations such as the Canadian Council for Refugees and the Migrant Rights Network to ensure that the perspectives of those with lived experiences are considered.

Previously, IRCC implemented the Guardian Angels temporary public policy during the COVID-19 pandemic. This policy provided a pathway to permanent residency for pending and failed refugee claimants working in patient care, benefiting over 8,500 individuals.

Currently, the temporary Public Policy for Out-of-Status Construction Workers in the Greater Toronto Area is in effect. It recognizes the economic contributions of construction workers while addressing their vulnerabilities. 

In late 2021, the Liberal government pledged to explore ways to regularize the status of undocumented workers contributing to Canadian communities. The Immigration Minister’s office indicated that a proposal will be presented to fellow cabinet ministers before Parliament’s summer break in June.

Prime Minister Trudeau highlighted the importance of maintaining the integrity of Canada’s immigration system, which he believes is why Canadians continue to support immigration, unlike many other countries.

This new initiative aims to balance rigorous immigration standards with compassion and support for undocumented migrants, reflecting Canada’s commitment to a fair and inclusive immigration system.
